Hardeeville police report sheds no light on oustings

A recent consultant report outlining the revamping of the Hardeeville police sheds no more light on the removal of at least four officers last year whose oustings were explained as a department "restructuring."
Former Staff Sgt. Rick Keefner, who was the first to leave when he was fired in May, said last week the report didn't explain why he lost his job. He said and believes that city officials' claims of a restructuring process a few weeks after he was fired were to get around the state's "at-will" employment laws that exempt emergency personnel from being fired unless there is a restructuring.
"My particular firing was illegal," said Keefner, adding he's consulting with a few attorneys about his case before filing suit against the city.
Whether the firing of Keefner or removal of other officers was illegal might not be that clear, depending on policies or contracts the department or city may have had, said Richard Banks, executive director of the S.C. Police Benevolent Association, an that has worked with Keefner on legal issues.
"Can the city manager do it? It might have to end up litigated in the courts. This could be a test case," said Banks, adding he was unable to obtain a copy of employment procedures from either police or city staff in Hardeeville.
"(The city manager) should've been restructuring before firing," he said.
Keefner said the former Chief James Hubbard, who was fired in January, told him there was nothing "illegal or unethical" reported in Keefner's personnel file, though Keefner hasn't seen it himself or requested it because he trusts what Hubbard told him, adding that he believes the city wanted him out because he had filed a lawsuit for a back injury he received on the job.
In the following weeks of Keefner's firing, two of the department's highest-ranking officers, Capt. Jerome White and Lt. Eric Washington, and two other police officers were forced to resign, along with the city's treasurer, Santesia Henderson.Hubbard was fired in January, followed by another officer's voluntary resignation, and another officer resigned the beginning of this month.
Hardeeville City Manager Shane Haynes said that although the label "restructuring" was attached to the personnel moves within the department, the external study wasn't the only source of justifying city actions -- just one component in a comprehensive review.
"The main reason was job performance and their ability to serve as a team member," he said. "They either resigned or were fired ... because they didn't buy into our goals. The report pointed out there were a lot of personal agendas."
Florida-based firm Police Management Consultants was hired to begin studying the department in August after the first five officers were ousted -- President Walter Zaliskosaid.
In the published report, the firm examines what it calls the "sound" structure of the department as it existed in February and not the high-ranking positions of captain and lieutenant that were eliminated in May and June.
Zalisko said he found nothing illegal in the department, but he never got to the bottom of why the officers were forced out just a few months before his report -- only that it affected the morale of the remaining officers.
Haynes said the city began the review of the department in late spring of last year and by June, after the first few police officers were forced out, it was "evident" that "we needed an objective, outside party" to examine what had been a "top-heavy" structure.Keefner said what he's heard of the report's findings, it "just pretty much downed the leadership."
"It wasn't very fair," he said. "They didn't talk to me. Nobody asked us (former officers) how the man was as a leader. Of course (current officers) are going to say everything the city wants to hear."
He added that it wasn't Hubbard's fault that new polices and rules hadn't been updated in written form since 1996, adding that the city stood in his way.
Hubbard didn't respond to requests for an interview.
Haynes called the notion that the city was preventing a department head from updating the department's own policies and procedures "absolutely incorrect." The city is updating a general city employee manual, but he said department heads have complete control and are encouraged to initiate police updates.
"It's very important to update policies," Haynes said. "They can make updates, which have to be reviewed by the city manager."
Two former high-ranking officers, who are black, Jerome White and Eric Washington, continue to pursue claims of racial discrimination against the city with the Equal Opportunity Employment Commission, their Bluffton lawyer Susan Brach said. She said the commission is investigating the claims and that it could take up to 1 1/2 years to reach a finding.
"At this point, what the city manager has done has caused unnecessary litigation against the city," said Banks of the police association. "Unfortunately, the taxpayers have to end up paying this bill," adding a department with such turmoil probably won't attract experienced officers who already have training.
Henderson, the city's treasurer who was forced to resign about the same time as her husband, Washington, has also filed a racial discrimination claim.
City officials, after not offering explanation for Henderson's ousting for weeks, said in July that irregularities were found in the city's finances and have ordered an audit into the matter.
Haynes said in the city's required annual external audit, no criminal activity or other "material weaknesses" were found, but 15 findings of procedural deficiencies in the finance department were cited. The full report will be released and reviewed at the City Council meeting April 19.

ANYONE who has worked there in the last couple of years knows thats a load of crap. Shane took control of that department away from Jimmy Hubbard a LONG time before firing him and made no secret about it either.

Amen brother! That was pointed out just a few days ago. The only certified officers they're gonna get applying there are the ones who have "problems" with their other departments and were either fired or "asked to leave".

Isn't being FORCED to resign through threats and intimidation, (which are PROVEN through the recorded meeting), pretty much the same as being fired? As usual Shane attempts here to make it sound as if those people left on a good note and weren't forced BY HIM to do so. As for personal agendas, yes there were a couple of a-holes working there but none of them had an "agenda" other than to serve the community the best way they knew how. The only people with "personal agendas" were Santesia, (lining her pockets as well as lining Shane's at the same time), and Dan Martin who's agenda should be quite evident to anyone at this point now that he is the "intern" chief. (That intern thing NEVER gets old! What an idiot.)

Welcome to the club Zalisko! Shane is now done with you and wil NOT ALLOW you to get to the bottom of why those officers were forced out. He only needed your report to lay the blame on someone else other than himself as he always does. Coward.

So the lieutenant's $5,533 comp time check from last February and Shane's huge "usual 80" comp time cash outs are now called "procedural deficiencies", huh? You know, you can wrap a pretty bow around a piece of sh*t but it still doesn't change the fact that it's a piece of sh*t. As for this "full report" being released and reviewed at the city council meeting on April 19, you can bet your life that those scumbags will be "reviewing" that report several days before it's release and editing it to say whatever they want it to say. You can also probably expect one of their famous filibuster executive sessions as well. Make it a good one guys! Your days are numbered!!

woo hoo Wiley...and to add a few comments: re: the reason for terminations being that the officers were not team members-you mean they weren't willing to board the ship (maybe because of their big guns and badges) and they didn't have the ability to be team players (probably patroling the streets rather than working for the ticket quota, otherwise labeled as low productivity) ..because they didn't buy into our goals (which would be...?) and there were personal agendas (are you talking about Martin's personal agenda that has been all but carried out, eliminating most on the firing list?)
And Zalisko has found nothing illegal in the department....COME ON....if that's not proof that the man's report wasn't thorough enough, or perhaps squashed, what is? How much questionable activity can go on before something is done?
The saddest thing is that not one of the elected officials that the citizens CHOSE to represent them have the cahooneys to say (in Shane's famous words) "ENOUGH". Obviously none of the council members have done a little research on their own into any of this, they are taking information offered to them as fact, instead of finding out for themselves. have any of the officers that have been terminated been interviewed by council? That may be too easy to reach a concensus.....

Also, Zalisko has been supposedly working on this report for several months but did anyone ever see him in Jimmy Hubbard's office or interviewing any of the officers to get their input? I think not. In addition, S made an excellent point about Martin's firing list. If that isn't the definition of a personal agenda then I don't know what is. I think most people know by now that Shane has denied time and time again to council that he told officers not to speak to any of them but yet when it gets captured on tape NONE of the council members reacts. Pathetic and gutless cowards. No better than a couple of the officers that remain there who very quickly turned into nothing more than brown nosers kissing up to the lieutenant just weeks after telling Jimmy Hubbard how sick of him they were and how they didn't trust him in the least bit. Soak it up lieutenant 'cause you can bet they'll be doing the exact same thing to Shane's new chief when he gets there and selling your ass up the river just as quickly as you sold Jimmy's.

I am back, for the moment, because this Website is slowly dying for lack of the common sense, civil dialogue. After reading the audit, I felt it suiting that I shed some light on the consultant’s comments. First, having a policy manual of 500 pages for a department the size of Hardeeville's is absurd. The length of a policy manual is no correlation for administrative or management capabilities. Heck, departments can a 25-page policy manual if the right chief and police officers are there. I know. I worked for one before. And, a 600-page policy manual will not suffice if the department is not led properly. I know. I see those examples all of the time. Consultants, for those of you who are not familiar, are nothing more than hired mouths of an organization. They conduct witch-hunts. They will find exactly what the organizations tell them to find and say exactly what they are told to say for a fee. That is a complete and total waist of taxpayers’ monies. Did you guys also know that Zalisko is a fired small town police chief from Oak Hill, FL. He did not last long enough to have any expertise about what he was allegedly evaluating. Actually, he came from NJ after retiring from the NJ State Police. He is unprofessional. He will not return telephone calls. He knows nothing about the intricacies of small southern towns and their police departments. This in all likelihood is his first consulting assignment. And he failed that as well. I have come to the conclusion that the city manager and most of council need to be replaced, and they will be. Abuse of power ALWAYS catch up with the abusers. The city would have done better with a local graduate student.

Coach, thank you so much for stating so eloquently what I, and probably others have wanted to say about Zalisko's findings. When I first saw it on the news, it was obvious to me that his "findings" were only what he was paid to say.

when i read coach's return, all i can say about his/her take on the consultant report is....DUH, DUH, and DUH!!! it's just still amazing that the city and council don't see it that way.
and do you know that supposedly there is a luncheon to welcome the new cheif today? i wouldn't be surprised if it turns out to be the same consultant...he seems to meet the credentials the city is looking for........
